This Privacy Notice presents Biosima’s commitment to Users and aims to transparently inform how each User’s personal data is collected, used, and stored, as well as issues related to retention, disposal, and security procedures. 

We believe in an empathetic and caring relationship and, therefore, we hope this document clarifies these issues for all those interested in what we have to offer, as a biotechnology company focused on the application and development of cellular processes for diagnostic and therapeutic purposes, aimed at human health.

To ensure you understand all the conditions of this document, please see below for some important definitions:

  • BIOSIMA: BIOSIMA – MEDICINA REGENERATIVA LTDA., a private legal entity registered under CNPJ number 47.635.783/0001-43, headquartered at Dezessete de Junho Street, No. 871, suite 202, Menino Deus neighborhood, in the city of Porto Alegre/RS, ZIP code 90110-170.
  • Users: all individuals who access Biosima’s website and who, eventually, interact with us through our functionalities.
  • Website: a virtual space created by Biosima to provide Users with relevant information about exosomal therapy.
  • Personal data: data related to an identified or identifiable individual, such as name, surname, and email address. When, through information, it is possible to identify a person, even indirectly, that information will be considered personal data for legal purposes and under this Privacy Notice.
  • Browsing Personal Data: data we collect when you visit the Platform, such as clicks, mouse movements, location, browser name and version, device brand and version accessing the platform, language preferences configured in the browser, screen size, page visibility, date and time, amount of time spent on pages, frequency of access, and which features of our Platform you visit.
  • LGPD: Brazilian Law nº. 13.709/2018, known as the General Data Protection Law. The LGPD is the Brazilian legislation that defines the rules for privacy and protection of personal data applicable, for example, to activities of collection, use, disposal, and sharing of Personal Data.

WHAT ARE OUR RESPONSIBILITIES IN THE COLLECTION OF PERSONAL DATA?

We, at Biosima, need to collect Users’ Personal Data to understand the Users’ navigation flow through our website and to be able to contact those Users who demonstrate their interest through our contact form.

We have established clear rules through this document, which include, for example, information about processing operations, such as collection, use, storage, and deletion of Users’ data, in accordance with the LGPD.

We have adopted standard practices for data collection, storage, and processing, as well as security measures to protect your personal information against unauthorized access, alteration, disclosure, or improper destruction.

We have also implemented technical and technological measures to prevent your data from being lost, altered, or accessed improperly. However, no security measure is perfect or impenetrable, so despite our efforts to maintain the security of personal data, there is a possibility of interception, theft, hacker attacks, or unauthorized access without this implying any fault on our part.

Nevertheless, if we identify the occurrence of any violation, alteration, intrusion, or similar event that impacts the personal data processed through our platform, we will be diligent and inform you of the extent of the violations, the impacted data, our strategies for solution or mitigation of effects, and any other information that may be relevant.

  • Revocation, at any time, of the consent given by you for specific Personal Data, and you may also request the deletion of this data, which will be fulfilled provided there is no legal requirement to maintain it or another legal basis that supports the non-deletion of the data;
  • Information about the possibility of not providing consent and the consequences of any refusal;
  • Portability of your Personal Data;
  • Information about public or private entities with which data is shared; and
  • Review of decisions made solely based on automated processing of personal data that affect your interests.

SHARING OF PERSONAL DATA

We share your information with our collaborators and occasional service providers. All internal recipients of the information are prohibited from disclosing and/or using the information for other purposes. We also require them to follow best practices in information security and comply with our methodologies.

As part of the uses of your data for the purposes mentioned above, we may disclose your personal information to:

  • Third-party entities such as service providers, commercial, financial, legal, security, research, and other services, whenever essential to the enablement of our services and products.
  • Third-party entities conducting audit work.
  • With public bodies and government authorities, in the following circumstances: (i) pursuant to a court order or at the request of a competent administrative authority to make such a request and (ii) to take legal, judicial, or administrative action to defend Biosima’s legitimate rights in judicial or administrative proceedings, always respecting the provisions established in this Privacy Notice.
  • With buyers of companies and/or assets in cases of corporate changes, mergers, or acquisitions involving Biosima, where the transfer will be necessary for the continuation of service provision.

THIRD-PARTY CONTENT

Our website may provide links to third-party websites, such as Instagram, Facebook, and YouTube. Since Biosima has no control over these websites, we are not responsible for the availability of the domains, and we are not responsible for any content, advertising, products, services, or other materials available on third-party websites.

Additionally, we do not guarantee that these third-party websites are free from viruses, spam, malicious software, or other harmful components. Users who access these websites do so at their own risk and should be aware that they are subject to the terms of use and privacy policies of these websites.

Complaints or questions regarding third-party services or third-party applications and products should be directed to the respective third party.

PRIVACY NOTICE UPDATE

This Privacy Notice can be amended at any time at Biosima’s discretion, with the main changes being communicated to you through a prominent notice on the Website.

In the event of significant changes or changes that reduce User rights, Biosima will send an email to registered Users in advance, indicating the date on which the said change will become effective. It is the User’s responsibility to alert any disagreement with the new terms.

FINAL PROVISIONS

If any provision of this Notice is deemed void or unenforceable, the portion in question will be disregarded, while the remaining provisions will remain valid, in full force and effect. The User declares to have read, understood, and accepted all the rules, conditions, and responsibilities established in this Notice.
